Photography / Videography Agreement

Terms and Conditions

This Agreement expresses the full and complete agreement between the CLIENT(S) (Partner 1 and Partner 2, named below) and KATSU NOJIRI PHOTOGRAPHY, regarding the photography and/or videography services for the CLIENT’s event. It supersedes all prior agreements, and any changes to this Agreement must be made in writing and agreed upon by both parties.

1. COOPERATION:

Unless otherwise noted, KATSU NOJIRI PHOTOGRAPHY, its associates, or employees will be the exclusive photographers/videographers at this event. The Parties agree that good faith cooperation and communication are essential to achieving the best results. CLIENTS should identify key individuals during the event if they wish them to be photographed. KATSU NOJIRI PHOTOGRAPHY will not be held accountable for missed moments if key individuals are not properly identified or gathered for photos. KATSU NOJIRI PHOTOGRAPHY is not responsible if key individuals fail to cooperate, are absent, or if certain moments are missed due to factors beyond our control.

2. HOUSE RULES:

CLIENTS understand and agree that the photographer(s)/videographer(s) are bound by the guidelines of the ceremony official or reception venue management. CLIENTS agree to accept any resulting limitations or issues caused by venue rules. Any negotiations regarding these guidelines are the CLIENTS’ responsibility.

3. IMAGES, EDITING, AND COPYRIGHTS:

All photographs, images, and videos produced by KATSU NOJIRI PHOTOGRAPHY are protected by copyright law. CLIENTS are granted the right to use these images for personal purposes only, and may not alter, reproduce, or redistribute these images for commercial use without written permission from KATSU NOJIRI PHOTOGRAPHY. CLIENTS must seek written permission if they or their associates intend to use the images for commercial purposes (e.g., publications or advertisements).

KATSU NOJIRI PHOTOGRAPHY does not provide unedited images. Only edited JPEG images, which may include coloUr correction, exposure adjustments, and artistic enhancements, will be delivered. Edited images do not include detailed retouching (e.g., removing tattoos or slimming body shapes).

4. SPECIFIC IMAGES:

KATSU NOJIRI PHOTOGRAPHY employs a highly stylized, photojournalistic approach. While every effort will be made to capture significant moments, the CLIENT acknowledges that KATSU NOJIRI PHOTOGRAPHY cannot guarantee the delivery of specific posed or prearranged shots. Any failure to deliver particular images will not constitute a breach of this Agreement.

5. CHANGE REQUESTS:

CLIENTS are entitled to one complimentary round of changes to the final video product for minor edits such as adjusting the timing of shots, modifying music, or reordering clips. Major revisions (e.g., re-editing large portions of the video) will incur an additional fee. Change requests must be submitted within 14 days of receiving the final product. For photography, KATSU NOJIRI PHOTOGRAPHY will not entertain change requests unless there are errors due to the photographer’s fault.

6. LIMITED WARRANTY:

KATSU NOJIRI PHOTOGRAPHY will exchange faulty soft copies of images/videos at no cost to the CLIENT within 60 days from the collection date. After this period, or if the fault arises due to the CLIENT's negligence or improper use, the CLIENT will be charged for replacements.

7. RETENTION & PAYMENT SCHEDULE:

A non-refundable retainer of AUD $1,000 for photography and AUD $1,000 for videography is due upon signing this Agreement. This retainer will be deducted from the total package price. In the event of cancellation, the retainer will be liquidated for damages. Any remaining balance is due 2 weeks prior to the event date. If additional hours are added during the event, payment for these additional hours must be made before the delivery of final images/videos.

8. LIMITATION OF LIABILITY:

While every effort will be made to capture important moments, KATSU NOJIRI PHOTOGRAPHY cannot guarantee specific shots, and its liability for missed moments, poor quality images due to external factors, or unforeseen circumstances is limited to the total amount paid by the CLIENT for services rendered.

In the event of injury, illness, or an emergency preventing the photographer or videographer from attending, KATSU NOJIRI PHOTOGRAPHY will make every effort to secure a replacement. If no suitable replacement is found, CLIENTS agree that liability is limited to the return of all payments received for the event.

9. ILLNESS AND UNEXPECTED EVENTS:

KATSU NOJIRI PHOTOGRAPHY will not be held liable for delays, cancellations, or substandard work caused by events beyond its control, such as natural disasters, illness, or other unforeseen circumstances. If a replacement photographer/videographer cannot be found, KATSU NOJIRI PHOTOGRAPHY will return all payments made and will have no further liability.

10. GUEST BEHAVIOR AND VENUE RULES:

CLIENTS understand that KATSU NOJIRI PHOTOGRAPHY is not responsible for substandard images caused by poor behavior from guests or venue restrictions. CLIENTS agree to assist in gathering key guests for photos and to ensure compliance with the venue’s rules.

11. NO UNAUTHORIZED THIRD-PARTY PHOTOGRAPHERS/VIDEOGRAPHERS:

No other professional photographers or videographers may photograph or film the event without prior written approval from KATSU NOJIRI PHOTOGRAPHY. Unauthorized third-party photographers may interfere with the work of the contracted photographer/videographer, and KATSU NOJIRI PHOTOGRAPHY cannot guarantee the quality of work under these circumstances.

12. COMPLETION SCHEDULE:

• Edited images will be delivered within 4 weeks after the event.

• Edited videos will be delivered within 15 weeks.

• Albums or additional products may take extra time to prepare.

13. CLIENT'S RESPONSIBILITIES:

CLIENTS must ensure a suitable environment for the photoshoot and video recording, including adequate lighting and space for the photographer's/videographer's equipment. CLIENTS are responsible for obtaining all necessary consents, permissions, and releases for the use of images/videos taken at the event.

14. USE OF COMMERCIAL MUSIC:

CLIENTS acknowledge and agree that if they request the use of commercial music in their photos, videos, or any other media produced by KATSU NOJIRI PHOTOGRAPHY, it is their responsibility to obtain the necessary licenses or permissions for the use of copyrighted music. KATSU NOJIRI PHOTOGRAPHY will not be held liable for any copyright infringement or legal issues arising from the use of unlicensed music. The CLIENT agrees to indemnify and hold KATSU NOJIRI PHOTOGRAPHY harmless from any claims, damages, or losses arising from the unauthorised use of commercial music.
